Registration/Participant Terms & Conditions

1. Participation and Fitness to Participate

Participants will engage in structured sport, games, and fitness-based activities designed for children and young people.

By registering a participant, the parent or legal guardian confirms that, to the best of their knowledge, the participant is:

  • fit and able to participate in physical activity; and

  • does not have any medical condition that would prevent safe participation without appropriate disclosure to Duck and Turtle Pty Ltd.

It is the responsibility of the parent or guardian to inform Duck and Turtle Pty Ltd of any relevant medical conditions, allergies, injuries, or support needs prior to participation.

Where necessary, reasonable adjustments will be made to support safe participation.

2. Acknowledgement of Risk

Participation in sport and physical activity involves inherent risks, including the risk of injury.

By registering a participant, you acknowledge and agree that:

  • participation is voluntary;

  • the participant will be exposed to physical activity;

  • there is a risk of personal injury or illness arising from participation; and

  • the participant participates with the consent of their parent or legal guardian.

To the extent permitted by law, you acknowledge that Duck and Turtle Pty Ltd is not liable for injuries or loss arising from participation except where required under Australian Consumer Law or where caused by negligence.

3. Medical Treatment and Emergency Care

In the event of injury or illness, Duck and Turtle Pty Ltd will take reasonable steps to provide appropriate first aid and seek emergency assistance where required.

You authorise Duck and Turtle Pty Ltd to:

  • obtain medical or emergency treatment for the participant if reasonably necessary; and

  • contact emergency services (including ambulance services) where required.

You acknowledge that any costs associated with medical treatment or ambulance transport remain the responsibility of the participant’s parent or guardian.

4. Release and Limitation of Liability

To the extent permitted by law, you release Duck and Turtle Pty Ltd, its directors, employees, contractors, and volunteers from liability for loss, damage, or injury arising from participation in activities.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under the Australian Consumer Law or other applicable legislation.

5. Communication and Marketing Consent

By registering, you consent to Duck and Turtle Pty Ltd contacting you via email or SMS regarding:

  • program updates

  • operational information

  • future programs and events

  • relevant organisational communications

You may opt out of marketing communications at any time.

6. Behaviour, Safety and Program Participation

Duck and Turtle Pty Ltd reserves the right to suspend or withdraw participation where a participant:

  • behaves in a manner that places themselves or others at risk;

  • fails to follow reasonable instructions from staff;

  • engages in behaviour that significantly disrupts the program; or

  • is assessed as unable to safely participate in activities.

Any decision will be made with regard to participant safety and program integrity.

7. Refund Policy

Refunds will be provided in accordance with Australian Consumer Law.

Subject to those rights:

  • no refund will be provided for non-attendance by the participant;

  • no refund will be provided where a participant chooses not to attend; and

  • refunds may be withheld where removal occurs due to serious misconduct.

Where Duck and Turtle Pty Ltd cancels a program or session, a refund or credit will be provided for the affected portion of the service.

8. Website Use Terms

By using this website, you agree to comply with these Terms and all applicable laws.

Duck and Turtle Pty Ltd provides website content in good faith and uses reasonable efforts to ensure accuracy. However, we do not guarantee that all information will always be current or error-free.

To the extent permitted by law, Duck and Turtle Pty Ltd is not liable for any loss arising from use of this website or reliance on its content.

This does not exclude any guarantees that cannot be excluded under the Australian Consumer Law.
