Registration/Participant Terms & Conditions

1. Participation and Fitness to Participate
Participants will engage in a range of structured sports, team games and physical activities designed for children and young people.
Duck and Turtle Pty Ltd welcomes participants of all abilities and is committed to providing an inclusive environment wherever it is reasonably practicable and safe to do so.
By registering a participant, the parent or legal guardian confirms that they have considered the nature of the activities offered and have provided complete and accurate information regarding any medical condition, disability, injury, allergy, medication, behavioural support need, developmental condition or other circumstance that may affect the participant's ability to safely participate or require additional support or reasonable adjustments.
Duck and Turtle Pty Ltd relies on the information provided by parents and guardians when assessing and managing the risks associated with a participant's involvement in its programs. Failure to disclose, or providing incomplete, inaccurate or misleading information about, a relevant medical condition, disability, injury, allergy, medication, behavioural support need, developmental condition or other circumstance may affect Duck and Turtle Pty Ltd's ability to safely assess, supervise or support the participant.
Parents and guardians are responsible for promptly notifying Duck and Turtle Pty Ltd of any changes to a participant's health, medical condition or support needs before or during the program.
Where relevant information is disclosed, Duck and Turtle Pty Ltd will consider whether reasonable adjustments can be made to support the participant's safe and meaningful participation, taking into account the participant's individual needs, available staffing and supervision, the nature of the activities, and the safety and wellbeing of all participants and staff.
If sufficient information is not provided, or if Duck and Turtle Pty Ltd reasonably determines that it cannot safely provide the level of supervision or support required, participation may be modified, postponed or declined following consultation with the parent or legal guardian. Where relevant information has not been disclosed or has been inaccurately disclosed, Duck and Turtle Pty Ltd may modify, suspend or discontinue participation where it reasonably considers this necessary to manage the associated risk.
2. Acknowledgement of Risk
Participation in sport and physical activity involves inherent risks, including the risk of injury.
By registering a participant, you acknowledge and agree that:
participation is voluntary;
the participant will be exposed to physical activity;
there is a risk of personal injury or illness arising from participation; and
risks may arise from the participant's own actions, the actions of other participants, the nature of the activity, equipment or the surrounding environment; and
the participant participates with the consent of their parent or legal guardian.
Duck and Turtle Pty Ltd takes reasonable steps to provide a safe environment and appropriately manage foreseeable risks. However, not all risks associated with physical activity can be eliminated. To the extent permitted by law, you acknowledge and accept the inherent risks associated with participation in the activities.
3. Medical Treatment and Emergency Care
In the event of injury or illness, Duck and Turtle Pty Ltd will take reasonable steps to provide appropriate first aid and seek emergency assistance where required.
You authorise Duck and Turtle Pty Ltd, its staff, contractors and volunteers to:
provide appropriate first aid within their level of training;
obtain medical or emergency treatment for the participant if reasonably necessary; and
contact emergency services (including ambulance services) where required.
You acknowledge that any costs associated with medical treatment or ambulance transport remain the responsibility of the participant’s parent or guardian. Every reasonable effort will be made to contact the parent or legal guardian as soon as practicable in the event of a significant injury, illness or emergency.
4. Release and Limitation of Liability
To the extent permitted by law, you acknowledge and accept the risks associated with the participant's involvement in Duck and Turtle activities and release Duck and Turtle Pty Ltd, its directors, employees, contractors and volunteers from liability for loss, damage, injury or illness arising from those inherent risks or from circumstances outside Duck and Turtle Pty Ltd's reasonable control.
Nothing in these Terms is intended to exclude, restrict or modify any rights, guarantees, warranties, remedies or liabilities that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable legislation.
5. Communication and Marketing Consent
By registering, you consent to Duck and Turtle Pty Ltd contacting you via email or SMS regarding information directly relating to your registration or participation, including:
program updates
operational information
future programs and events
relevant organisational communications
You may opt out of marketing communications at any time.
6. Behaviour, Safety and Program Participation
Duck and Turtle Pty Ltd reserves the right to suspend or withdraw participation where a participant:
behaves in a manner that places themselves or others at risk;
fails to follow reasonable instructions from staff;
repeatedly fails to follow reasonable safety instructions;
engages in behaviour that significantly disrupts the program; or
is reasonably assessed as unable to safely participate in the activity with the level of supervision or support available.
Any decision will be made with regard to participant safety and program integrity. Nothing in this section is intended to prevent Duck and Turtle Pty Ltd from taking immediate action where reasonably necessary to protect the safety of a participant, staff member or other person.
7. Refund Policy
Refunds will be provided in accordance with Australian Consumer Law.
Subject to those rights:
no refund is required to be provided for non-attendance by the participant;
no refund is required for non-attendance where the participant chooses not to attend; and
refunds may be withheld where participation is withdrawn due to serious misconduct or a significant safety concern arising from the participant's conduct, subject always to applicable law.
Where Duck and Turtle Pty Ltd cancels a program or session, a refund or credit will be provided for the affected portion of the service.
8. Website Use Terms
By using this website, you agree to comply with these Terms and all applicable laws.
Duck and Turtle Pty Ltd provides website content in good faith and uses reasonable efforts to ensure accuracy. However, we do not guarantee that all information will always be current or error-free.
To the extent permitted by law, Duck and Turtle Pty Ltd is not liable for any loss arising from use of this website or reliance on its content. This does not exclude any guarantees that cannot be excluded under the Australian Consumer Law.
9. Privacy
Duck and Turtle Pty Ltd is committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal and health-related information provided during registration may be collected and used for purposes including assessing and managing participant safety, providing appropriate support or reasonable adjustments, responding to medical or other emergencies, administering programs and registrations, communicating with parents or guardians, and meeting legal or regulatory obligations.

12. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the jurisdiction of the courts of South Australia.
